Waiver of Liability / Assumption of Risk / Photo & Video Release

READ CAREFULLY AND ACCEPT BELOW

I hereby indemnify, release and forever hold harmless the Better Balance Dance Studio, including its owners, employees, and instructors ( “Better Balance Dance”), from any and all claims of liability arising from any accident, personal injury, death, property loss or damage sustained by my child(ren)/myself/the minor child(ren) for whom I am a legal guardian (the “Participant”), while the Participant is engaged in activities connected with Better Balance Dance, including classes, rehearsals, performances, or other activities, or is located on any of the premises utilized by Better Balance Dance before, during, or after such activities.

I understand that dance and theater activities have inherent risks of injury, and, being fully aware of all risk, I consent to have the Participant participate in the classes and activities offered by Better Balance Dance, and I accept full responsibility for providing adequate health and accident insurance coverage for the protection of the Participant. By accepting and consenting to this statement, I declare that the Participant is in good health, with no physical conditions that might prevent participation in strenuous and rigorous dance activities and other training and performance connected with musical theater. I understand that I should be aware of the Participant’s physical limitations and agree not to exceed them.

Further, I understand and acknowledge that because of the physical nature of dance, there may be physical contact between instructors, teachers, and students during rehearsals, shows, workshops, productions, and especially during dance instruction. I understand that at times for proper instruction and safety, physical contact is required and necessary.

Furthermore, I and the Participant agree to obey the class and facility rules and take full responsibility for my/our behavior in addition to any damage I/we may cause to the facilities utilized by Better Balance Dance.

Further, I authorize and agree that Better Balance Dance may take and use photographs/videos of me and/or the Participant for purposes of record keeping, advertising, and marketing. I understand that I do not have any rights to these photographs/videos and will not be compensated for the same.

I have carefully read the contents of this waiver form and fully understand its contents. I understand that this is an assumption of risk and release of liability, and I accept it of my own free will.

COVID-19*

The act of dancing, and particularly participation in dance instruction, necessarily involves students and instructors being in close physical proximity. We are taking precautions as advised by the CDC and other federal, state, and local governments and agencies that publish best-practice guidelines, which may include the use of face masks, restrictions on drop-off and pick-off times, and other measures during all or part of the scheduled semester. Even with such precautions in place, you agree to accept all related risk, as well as all liability should you or your child be exposed to, or infected with, the COVID-19 virus, and you also release the Studio from any such liability. If you are not comfortable accepting such liability, you should enroll your child exclusively in virtual classes only this semester. By checking the box below, or by permitting your child to attend any in-person classes, you accept this waiver of liability.
